The dismissal of a protected employee requires a specific justification, even in the event of a reorganisation

In its decision of 21 February 2017, the Brussels Labour Court had to rule on the legality of the dismissal in the context of a reorganisation of an employee who benefited a specific protection against dimissal. 

The Labour Court ruled that the employer was able to substantiate the reorganisation but failed to deliver prove of the reason why this specific employee was dismissed and not another colleague. As a consequence, the employer had to pay the additional compensation fee.
